DELIVERY POLICY – WEBSITE AND ONLINE STORE
(hereinafter referred to as the “Policy”)
1. INTRODUCTION
1.1 This Policy is only valid for goods purchased (“Goods”) via the Agrimark Operations Limited t/a Agrimark (“Agrimark”) website and online store.
1.2 This Policy has been developed to ensure the accurate and secure delivery of all Goods according to your delivery needs.
1.3 Agrimark offers 2 methods of delivery of Goods to you. You may elect delivery via:
1.3.1 Delivery to your door; or
1.3.2 Click and Pick Up.
2. DELIVERY TO YOUR DOOR
2.1 Express delivery (1 to 3 working days) is subject to stock availability, and only applies to Goods accordingly identified.
2.2 Orders placed on a Friday will be delivered on the following Monday or Tuesday. In the case of a mixed basket, Agrimark’s standard delivery policy of 3 to 5 working days will apply to the delivery of the Goods, except for Goods ordered through the Endless Aisle.
2.3 Agrimark can only deliver Goods to physical addresses within the borders of the Republic of South Africa.
2.4 Standard deliveries (except Endless Aisle orders) will be made within 3 to 5 business days upon acceptance of your order. Note, for certain outlying areas we have to use regional third-party couriers and while every effort is made to expedite delivery, service to these areas may take an additional 2 days.
2.5 Orders made through the Endless Aisle functionality on Agrimark’s website and online store shall be delivered before the end of the calendar month in which the order has been placed.
2.6 Quoted delivery times are a guide only and while Agrimark endeavours to meet the targeted delivery times for both express delivery and standard deliveries, from time to time factors beyond the control of Agrimark can result in delayed delivery.
2.7 A unique order number will be communicated to you via email which can be used to track the status of your order.
2.8 Your deliveries will be made through our designated courier company or the Agrimark Service Centre.
2.9 Once you have indicated your address and you have received confirmation of your order, no changes to the specified address and/or delivery option will be accepted.
2.10 Agrimark reserves the right to contact customers and arrange alternative delivery methods and timelines if your delivery address is remote or to cancel the order if delivery is not feasible.
2.11 Before you finalise your order, you have the option to indicate in the "Notes" field whether the order should only be delivered to you or you can specify an alternative authorized person's name to receive it on your behalf. You or the authorized person will be required to show proof of identification to the courier upon delivery.
2.12 In order to safeguard your purchase, the carrier will only deliver to the specified address and to you or one of the people indicated on the notes of the order as being authorised to receive your parcel.
2.13 The courier will request proof of identity from the person receiving the parcel if this was indicated in the "Notes" field of the order.
2.14 All parcels delivered will be secured with a unique purchase sealing tape. Should this be broken, please follow the guidance in 2.16 below.
2.15 The person receiving the parcel will be asked by the courier to sign the waybill indicating that the parcel/carton has been received undamaged and in good condition.
2.16 Proof of identification may be requested to verify authenticity of purchaser.
2.17 In the unlikely event that the parcel/carton is damaged and/or the security seal is broken, then the receiving person can either:
2.17.1 check the parcel in front of the driver and indicate on the courier's waybill (delivery documentation) whether there are any:
2.17.1.1 breakages, and/or
2.17.1.2 damages and/or
2.17.1.3 items missing.
2.18 Both parties (the courier and the person receiving the parcel(s)) will need to co-sign their names against this indication. If the receiving person chooses to still accept the damaged carton, the waybill will reflect that a damaged parcel was received and accepted with both parties co-signing; or send the parcel back and indicate on the waybill the reasons for sending the parcel back. Both parties will need to co-sign against this indication.
2.19 Free delivery is currently offered on standard online orders with a purchase value of R1,000.00 (One Thousand Rand) or more (inclusive of VAT), provided that the order qualifies for standard delivery services. Agrimark reserves the right to determine eligibility for free delivery based on the actual weight, volumetric weight, dimensions, destination, and any other logistical considerations applicable to the order.
2.20 Notwithstanding the above, certain products or orders may be excluded from free delivery where, in Agrimark's reasonable discretion, the size, weight, volumetric weight, handling requirements, delivery location, or other operational factors result in additional delivery costs. Any applicable delivery charges will be communicated to the customer accordingly.
2.21 Agrimark reserves the right to amend, suspend, withdraw, or discontinue the free delivery offering, whether temporarily or permanently, at any time and without prior notice. The minimum order value and qualifying criteria for free delivery may also be reviewed and adjusted by Agrimark from time to time at its sole discretion.
2.22 Agrimark reserves the right, at its sole discretion, to impose quantity limits on items. These limits will be managed by Agrimark and are designed to ensure safe and efficient delivery. Customers will be notified of any applicable restrictions during the ordering process.
2.23 Any misuse including but not limited to fraudulent orders, or conduct intended to disrupt normal operations, may result in the suspension or cancellation of orders at Agrimark’s sole discretion. Agrimark is further entitled, for purposes of preventing suspected fraud and/or abuse of the ordering system to blacklist you on its database (including suspending or terminating your access to its services), refuse to accept or process payment on any order, and/or cancel any order, in whole or in part, on notice to your. In such cases, Agrimark shall only be liable to refund monies already paid by yourself (subject to its applicable Returns Policy) and accepts no other liability arising from such blacklisting, refusal, or cancellation.
2.24 Agrimark reserves the right to refuse service, cancel orders and terminate accounts at its sole discretion.
3. CLICK AND PICK UP
3.1 The Click and Pick Up service allows you to place orders for Goods online through Agrimark’s website and online store and collect the Goods at a chosen Agrimark store.
3.2 In order to utilise this delivery option, you will be required to select the "Click and Pick Up" option upon checkout of your Goods, whereby you will be able to choose a preferred store location and pick-up time slot, if available, for the collection of your Goods.
3.3 Upon checkout, you will receive an order confirmation e-mail or SMS once your order is placed with Agrimark.
3.4 Thereafter, an electronic notification, by way of e-mail or SMS, will be sent to you when your order is ready for collection from your chosen Agrimark store.
3.5 In order to collect your Goods at the chosen Agrimark store, you are required to present your order confirmation email or SMS on hand, as well as a valid ID or driver’s licence, to Agrimark store personnel for identification and verification purposes.
3.6 You will be able to collect your order during the operating hours of your chosen Agrimark store and within the designated pick-up time slot, if applicable.
3.7 Orders must be picked up within 3 working dates of the notification that the order is ready. The failure to do so by yourself may result in the cancellation of your order and/or restocking fees and/or storage fees.
3.8 Orders cannot be cancelled or modified once they are processed and ready for pick-up.
3.9 If you need to make changes to your chosen Agrimark store (i.e. pick-up location), please contact our customer service team as soon as possible.
3.10 If there is an issue with your order at pick-up, please notify the requisite Agrimark personnel present immediately.
3.11 Agrimark is responsible for ensuring that your order is prepared correctly and is available for pick-up at your chosen Agrimark store, and as such, Agrimark are not liable for any loss or damage to the Goods once the Goods have been collected by yourself.
4. GENERAL
4.1 Any refunds and/or returns are subject to Agrimark’s Returns Policy. Please review the Returns Policy for specific details.
4.2 This Policy and any legal proceedings flowing from it will be governed by the laws of the Republic of South Africa.
4.3 You consent and agree that Agrimark may, but is not obliged to, have any dispute, disagreement or claim arising out of this agreement finally resolved in the Magistrate’s Court having jurisdiction in respect of yourself, notwithstanding that the amount in issue may exceed the jurisdiction of such Court.
4.4 In the event of Agrimark having to institute legal proceedings of whatsoever nature against the purchaser, you will be liable for Agrimark’s legal costs on the scale as between attorney and own client, including collection commission.
4.5 Notwithstanding anything to the contrary stated herein, Agrimark shall not be liable to yourself for any indirect, special or consequential damages and/or losses of whatsoever nature or howsoever arising (including but not limited to loss of revenue, loss of business opportunity and loss of data).
4.6 No agreement to amend, add to or otherwise vary or waive any of the provisions of this Policy, including this clause, or to cancel or terminate it shall be effective unless made in writing and duly signed by Agrimark.
4.7 Nothing in this Policy shall in any way, be interpreted or intended to transfer cede assign, make over or in any other way pass over any right title or interest in and to Agrimark intellectual property to the purchaser for the duration of this agreement or any part thereafter.
4.8 If any provision of this Policy, is found or held to be invalid or unenforceable, such terms will be severable from the remaining terms, which will continue to be valid and enforceable.
